Terms of Service

Welcome to Xsension. These Terms of Service ("Terms") govern your use of the Xsension mobile application (the "App") operated by Xsension ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.

1. Description of Service

Xsension is an AI-powered appearance and lifestyle analysis application. The App allows you to:

• Complete a questionnaire about your lifestyle habits and physical attributes
• Optionally upload photos for visual analysis
• Receive a personalized analysis with scores across five categories: Facial Presentation, Skin & Grooming, Physique & Posture, Style Potential, and Lifestyle & Habits
• Get actionable recommendations for self-improvement
• Track your progress over time with periodic re-assessments

2. Important Disclaimers

Not Medical or Professional Advice. The analyses, scores, and recommendations provided by Xsension are generated by artificial intelligence and are for informational and motivational purposes only. They do not constitute medical, dermatological, nutritional, fitness, psychological, or any other form of professional advice.

Subjective Scores. Scores and ratings are generated by AI algorithms and are inherently subjective. They should not be interpreted as objective measurements of your appearance, health, or worth. Do not make health or medical decisions based solely on information from this App.

Consult Professionals. Always seek the advice of qualified health, fitness, or other professionals for any questions regarding your health or well-being.

No Guarantees. We do not guarantee any specific results from following the App's recommendations. Individual results will vary.

3. Account Registration

• You must be at least 13 years old to create an account
• You may register using an email address and password, or through Apple Sign-In
• You must provide accurate and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You must not create multiple accounts or share your account with others
• You are responsible for all activity that occurs under your account

4. Subscriptions and Payments

Subscription Required. Access to analysis results, recommendations, and progress tracking requires an active subscription.

Payment Processing. All subscriptions are purchased through Apple's in-app purchase system. Payment is charged to your Apple ID account.

Trial Period. We may offer a trial period for new subscribers. After the trial period ends, your subscription will automatically convert to a paid subscription unless canceled.

Auto-Renewal. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.

Cancellation. You can cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period — you will retain access until then.

Refunds. Refund requests are handled by Apple according to their refund policies. We do not process refunds directly.

Price Changes. We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing period, and you will be notified in advance.

5. User Content

Ownership. You retain full ownership of all content you provide to the App, including photos and questionnaire responses.

License. By uploading content to the App, you grant us a limited, non-exclusive license to use, process, and store that content solely for the purpose of providing the App's services to you (e.g., generating your analysis, storing your progress history).

Photo Processing. Photos you provide are stored only on your device. During analysis, they are sent securely to our server and forwarded to our AI analysis provider (OpenAI) for processing. Photos are not stored on our servers and are used exclusively for generating your analysis.

Responsibility. You are solely responsible for the content you upload. You must not upload content that is illegal, harmful, or that you do not have the right to share.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Upload photos of other people without their consent
• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our servers, databases, or other systems
• Use the App to harass, abuse, or harm others
• Interfere with or disrupt the App's functionality
• Use automated systems (bots, scrapers) to access the App
• Circumvent any access controls or usage limits
• Resell, redistribute, or commercially exploit the App or its content

7. Intellectual Property

The App, including its design, user interface, analysis algorithms, scoring system, branding, and all related intellectual property, is owned by Xsension and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in our Privacy Policy.

9. Analysis Rate Limits and Additional Analysis Credits

Rate Limits. To ensure quality and fair usage, analyses are limited to one per seven-day period. This allows you to implement recommendations and observe meaningful changes between assessments.

Additional Analysis Credits. You may purchase additional analysis credits ("Credits") as in-app consumable purchases. Credits allow you to perform analyses beyond the standard weekly limit. Credits are non-transferable, have no cash value, and cannot be exchanged or redeemed for cash or any other form of compensation.

No Refunds on Credits. All Credit purchases are final and non-refundable. Unused Credits are forfeited upon account deletion, whether initiated by you or by us due to a violation of these Terms. No refunds, including pro-rated refunds, will be issued for unused Credits under any circumstances.

10. Account Termination

By You. You may delete your account at any time by contacting us at founder.xsension@gmail.com. Upon deletion, all your data (including analysis results, recommendations, and personal information) will be permanently removed from our servers.

By Us. We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the App in a manner that could harm other users or our systems. We will make reasonable efforts to notify you before termination, except in cases of severe violations.

Effect on Purchases. If your account is deleted — whether by you or by us for a violation of these Terms — all unused Additional Analysis Credits are permanently forfeited. No refunds, including pro-rated refunds, will be issued for unused Credits or for any remaining time on an active subscription. It is your responsibility to cancel your subscription through your Apple ID account settings before deleting your account.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind, whether express or implied
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim
• We are not responsible for any decisions you make based on the App's analyses or recommendations

12. Indemnification

You agree to indemnify and hold harmless Xsension and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. We will notify you of material changes through the App or via email. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the App and delete your account.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of the United States.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Xsension regarding your use of the App and supersede any prior agreements.
