Terms of Service

Welcome to Xsension. These Terms of Service ("Terms") govern your use of the Xsension mobile application (the "App") operated by Xsension ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.

1. Description of Service

Xsension is an AI-powered grooming, style, and lifestyle self-improvement application. The App allows you to:

• Complete a questionnaire about your lifestyle habits and physical attributes
• Optionally upload photos for AI-generated visual insights
• Receive a personalized, AI-generated analysis with qualitative scores across five categories: Facial Presentation, Skin & Grooming, Physique & Posture, Style Potential, and Lifestyle & Habits
• View a general body fat percentage estimate (non-medical) based on your inputs
• Get general, non-expert lifestyle and grooming suggestions for self-improvement
• Track your progress over time with periodic re-assessments
• Compare before/after photos stored locally on your device

2. Important Disclaimers — Please Read Carefully

Not Medical or Professional Advice. The analyses, scores, body fat percentage estimates, feedback, and suggestions provided by Xsension are generated by artificial intelligence and are provided for informational, educational, and self-improvement purposes only. They do not constitute medical, dermatological, nutritional, fitness, psychological, or any other form of professional advice, diagnosis, or treatment.

No AI Citations. The App's AI-generated content is produced from a language model's general training data. It does not pull from or cite specific studies, research, clinical sources, or professional databases in real time. You should independently verify any health- or lifestyle-related information before acting on it.

Qualitative Scores Only. Scores, ratings, and body fat percentage estimates are qualitative indicators generated by AI and are inherently subjective and approximate. They are not clinical measurements and should not be interpreted as objective or diagnostic assessments of your appearance, health, body composition, or worth.

Consult Professionals. Always seek the advice of a qualified healthcare provider, licensed dermatologist, certified fitness professional, registered dietitian, or other relevant professional for any questions regarding your health, skin, diet, fitness, or lifestyle, and before making changes based on anything you see in the App.

A list of publicly available, authoritative organizations where you can learn more about the topics Xsension discusses is available in the App under Profile → Legal → Sources & Medical Disclaimer. These references are provided as general educational resources only and are not citations for any specific AI-generated output.

No Guarantees. We do not guarantee any specific results from following the App's suggestions. Individual results vary.

Not for Emergencies. Xsension is not intended for use in medical or mental health emergencies. If you are experiencing a medical emergency, call your local emergency number immediately.

3. Age Requirements and User Eligibility

• You must be at least 13 years old to create an account
• Users under 18 are restricted from uploading photos within the App
• You may register using an email address and password, or through Apple Sign-In
• You must provide accurate information during registration
• You are responsible for maintaining the security of your account credentials
• You must not create multiple accounts or share your account with others
• You are responsible for all activity that occurs under your account

4. Account Management

Email and Password Changes. If you signed up with an email address and password, you may change your email address or password at any time from the Profile screen. Password changes require verification of your current password.

Apple Sign-In Users. If you signed up with Apple Sign-In, your credentials are managed entirely by Apple. You cannot change your email or password through Xsension; these must be managed through your Apple ID settings.

Display Name and Goal. You may update your display name and fitness goal at any time from the Profile screen.

5. Subscriptions and Payments

Subscription Required. Access to full analysis results, lifestyle suggestions, and progress tracking requires an active subscription.

Payment Processing. All subscriptions are purchased through Apple's in-app purchase system. Payment is charged to your Apple ID account.

Trial Period. We may offer a trial period for new subscribers. After the trial period ends, your subscription will automatically convert to a paid subscription unless canceled.

Auto-Renewal. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.

Cancellation. You can cancel your subscription at any time through your Apple ID account settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period — you will retain access until then.

Refunds. Refund requests are handled by Apple according to their refund policies. We do not process refunds directly.

Price Changes. We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing period, and you will be notified in advance.

6. Analysis Rate Limits and Additional Analysis Credits

Rate Limits. To ensure quality and fair usage, analyses are limited to one per seven-day period. This allows you time to implement suggestions and observe changes between assessments.

Additional Analysis Credits. You may purchase additional analysis credits ("Credits") as in-app consumable purchases. Credits allow you to perform analyses beyond the standard weekly limit. Credits are non-transferable, have no cash value, and cannot be exchanged or redeemed for cash or any other form of compensation.

No Refunds on Credits. All Credit purchases are final and non-refundable. Unused Credits are forfeited upon account deletion, whether initiated by you or by us. No refunds, including pro-rated refunds, will be issued for unused Credits under any circumstances.

7. User Content

Ownership. You retain full ownership of all content you provide to the App, including photos and questionnaire responses.

License. By uploading content to the App, you grant us a limited, non-exclusive license to use, process, and store that content solely for the purpose of providing the App's services to you (e.g., generating your analysis, storing your progress history).

Photo Processing and Storage. Photos you provide are stored locally on your device using iOS Core Data for use in your gallery and before/after comparisons. During analysis, photos are sent securely to our server and forwarded to our AI analysis provider (OpenAI) for processing. Photos are not permanently stored on our servers after analysis is complete.

Responsibility. You are solely responsible for the content you upload. You must not upload content that is illegal, harmful, explicit, or that you do not have the right to share. You must not upload photos of other people without their consent.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Upload photos of other people without their consent
• Upload explicit, pornographic, or otherwise inappropriate content
• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our servers, databases, or other systems
• Use the App to harass, abuse, or harm others
• Rely on the App as a substitute for medical, mental health, or professional advice
• Interfere with or disrupt the App's functionality
• Use automated systems (bots, scrapers) to access the App
• Circumvent any access controls, rate limits, or usage restrictions
• Resell, redistribute, or commercially exploit the App or its content

9. Intellectual Property

The App, including its design, user interface, scoring system, category definitions, branding, and all related intellectual property, is owned by Xsension and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

Trademarks and service marks of third-party organizations referenced in the App (e.g., in the Sources & Medical Disclaimer section) are the property of their respective owners. Xsension is not affiliated with, endorsed by, or sponsored by any of the organizations listed in the Sources section.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in our Privacy Policy.

11. Notifications and Communications

By opting in to push notifications, you may receive reminders for daily tasks, weekly check-ins, and optional announcements about new features, deals, and important app updates. You may manage or disable any notification category at any time from the Profile screen or from your device's system settings.

12. Account Termination

By You. You may delete your account at any time from the Profile screen or by contacting us at founder.xsension@gmail.com. Upon deletion, all your data (including analysis results, progress history, body fat estimates, and personal information) will be permanently removed from our servers.

By Us. We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the App in a manner that could harm other users or our systems. We will make reasonable efforts to notify you before termination, except in cases of severe violations.

Effect on Purchases. If your account is deleted — whether by you or by us for a violation of these Terms — all unused Additional Analysis Credits are permanently forfeited. No refunds, including pro-rated refunds, will be issued for unused Credits or for any remaining time on an active subscription. It is your responsibility to cancel your subscription through your Apple ID account settings before deleting your account.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind, whether express or implied
• We do not warrant that the App, its scores, its body fat estimates, or its AI-generated suggestions are accurate, complete, reliable, or suitable for any particular purpose
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim
• We are not responsible for any decisions you make based on the App's scores, feedback, body fat estimates, or suggestions, and we strongly discourage making medical, dietary, skincare, or fitness decisions based solely on the App

14. Indemnification

You agree to indemnify and hold harmless Xsension and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. We will notify you of material changes through the App or via email. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the App and delete your account.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of the United States.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Xsension regarding your use of the App and supersede any prior agreements.

19. Apple App Store Terms

The following terms apply if you downloaded the App from the Apple App Store and are required by Apple to be included in these Terms:

Acknowledgment. These Terms are entered into solely between you and Xsension, and not with Apple Inc. ("Apple"). Xsension, not Apple, is solely responsible for the App and its content. These Terms may not provide for usage rules that are in conflict with, or violate, the Apple Media Services Terms and Conditions as of the effective date of these Terms.

Scope of License. The license granted to you for the App is a limited, non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

Maintenance and Support. Xsension is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms, or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Warranty. Xsension is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Xsension.

Product Claims. You and Xsension acknowledge that Xsension, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of any HealthKit or HomeKit frameworks (if applicable).

Intellectual Property Rights. You and Xsension acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Xsension, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Developer Name and Contact. Direct any questions, complaints, or claims about the App to Xsension at founder.xsension@gmail.com.

Third Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the App.

Third Party Beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
